Terms of Service
1. Acceptance of Terms
By accessing or using the Foodie and Bandit platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. Description of Service
Foodie and Bandit is a marketplace connecting independent food runners ("Runners") with buyers ("Buyers"). Runners source prepackaged regional specialty foods and offer them for preorder. Buyers place preorders during an open ordering window and pick up at a specified location and time.
Foodie and Bandit is not a food producer, retailer, or delivery service. We facilitate transactions between Runners and Buyers but do not take possession of, prepare, or transport food items.
3. Accounts
You must create an account to place orders or operate as a Runner. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old to use the Platform.
4. Orders and Payments
Preorders are reservations, not guaranteed purchases. Runners source items on a best-effort basis. If a Runner cannot fulfill part of your order, you will receive an automatic partial refund for unfulfilled items. Full refunds are issued if a run is cancelled.
Payments are processed through Stripe. By placing an order, you authorize the charge to your payment method. Platform fees, if applicable, are disclosed at checkout before you confirm your order.
5. Runner Obligations
Runners are independent operators, not employees or agents of Foodie and Bandit. Runners are responsible for: sourcing items as described, arriving at the designated pickup location during the stated window, handling food safely and in compliance with applicable laws, and accurately representing item descriptions and pricing.
6. Disputes
If an order issue arises (missing items, quality concerns, no-show at pickup), Buyers may file a dispute through the Platform. Disputes are reviewed and resolved according to our operations policy. Foodie and Bandit's resolution is final.
7. Prohibited Conduct
You may not: use the Platform for unlawful purposes, misrepresent your identity or affiliation, manipulate inventory or pricing to deceive other users, interfere with the operation of the Platform, or create multiple accounts to circumvent suspension.
8. Limitation of Liability
Foodie and Bandit is provided "as is" without warranties of any kind. We are not liable for the quality, safety, or legality of items sold through the Platform, nor for any indirect, incidental, or consequential damages arising from your use of the Platform.
9. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, any pending payouts will be processed according to our standard schedule, less any amounts owed due to disputes or chargebacks.
10. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance. We will notify registered users of material changes via email.
